Terms Of Service.
1. Equipment Use & Condition
The Renter acknowledges that the "OutBox" contains camping equipment. By signing this agreement, the Renter agrees that:
Items are to be used only for their intended purpose. Misuse of equipment is strictly prohibited.
No Instruction Provided: The Owner is not responsible for educating or training the Renter on how to use the equipment (e.g., setting up tents, operating stoves, or using tools). The Renter acknowledges they are competent in the use of such equipment or will seek independent instruction.
2. Liability Release & Assumption of Risk
The Renter understands that camping and outdoor activities involve inherent risks, including but not limited to weather, wildlife, and the use of fire or sharp tools.
Release: The Renter hereby releases, waives, and discharges the Owner from any and all liability, claims, or demands for personal injury, death, or property damage arising out of the use, or misuse, of the rented equipment.
Accidents: The Owner is not responsible for any accidents, injuries, or health issues sustained by the Renter or any third parties during the rental period.
3. Security Deposit, Damage, & Theft
A security deposit is required at the time of pickup/delivery.
Refunds: The deposit will be refunded in full upon return of the equipment, provided all items are in working order, clean, and free of damage.
Broken/Stolen Items: If any items are returned broken, damaged beyond "normal wear and tear," or are missing/stolen, the cost of repair or replacement will be deducted from the security deposit. If the cost exceeds the deposit, the Renter agrees to pay the difference within 7 days.
4. Late Returns
The equipment must be returned by the agreed-upon date and time.
Late Fees: If the equipment is not returned on time, a daily rental rate of $150 will be charged for every day (or partial day) the equipment is late, in addition to the original rental duration fee.
5. Equipment Inspection & Acceptance
The Renter agrees to inspect all equipment at the time of pickup or delivery and acknowledges that the equipment is received in good working condition.
By accepting the equipment, the Renter confirms that it is safe and suitable for use. Any issues must be reported prior to use. Failure to report issues constitutes acceptance of the equipment “as-is.”
6. Indemnification (Critical Clause)
The Renter agrees to indemnify, defend, and hold harmless the Owner, its members, employees, and affiliates from any and all claims, damages, losses, liabilities, costs, and expenses (including attorney fees) arising from the Renter’s use, misuse, or possession of the equipment.
8. Medical Responsibility
The Renter affirms that they are physically and mentally capable of participating in outdoor and camping activities. The Owner is not responsible for medical expenses, evacuation costs, or emergency services related to injuries or illness occurring during the rental period.
9. Prohibited Uses
The equipment may not be used:
For commercial purposes
In illegal activities
While under the influence of drugs or alcohol
In restricted areas, during fire bans, or where camping is prohibited
By anyone other than the Renter and their immediate party
10. Fire, Stove, & Fuel Disclaimer
The Renter assumes all responsibility for the safe use of stoves, fuel, fire starters, and open flames. The Owner is not responsible for fires, burns, carbon monoxide exposure, explosions, or violations of local fire regulations.
11. Weather & Environmental Conditions
The Renter assumes all risks associated with weather conditions, including extreme heat, cold, storms, wind, flooding, and wildlife encounters.
No refunds will be issued due to weather conditions or environmental factors.
12. Minors
The Renter is solely responsible for the supervision and safety of any minors using the equipment. No equipment may be rented directly to individuals under 18 years of age.
13.Definitions
For purposes of this Agreement:
Owner means OutBox Outdoor, its owners, members, managers, employees, contractors, agents, successors, and assigns.
Renter means the individual signing this Agreement and accepting possession of the rented equipment. The Renter is responsible for ensuring that all members of their party comply with the terms of this Agreement.
Immediate Party means any family members, guests, invitees, friends, companions, minors, or other individuals who use, access, transport, possess, or are present with the rented equipment during the rental period, whether or not they are specifically identified in this Agreement.
14. Acknowledgment of Risks, Injury, and Death
The Renter acknowledges that camping, outdoor recreation, transportation of equipment, use of tents, stoves, fuel, campfires, tools, cooking equipment, and related outdoor activities involve inherent and unforeseeable risks that may result in property damage, illness, serious bodily injury, permanent disability, or death.
The Renter voluntarily assumes all such risks for themselves and for all members of their Immediate Party. The Renter understands and agrees that the Owner cannot eliminate all hazards associated with the use of the equipment or participation in outdoor activities.
To the fullest extent permitted by law, the Renter releases, waives, and discharges the Owner from any and all claims, demands, causes of action, damages, losses, liabilities, costs, and expenses arising from or related to personal injury, illness, disability, death, property damage, or other losses sustained by the Renter or any member of the Immediate Party resulting from the use, misuse, transportation, possession, or operation of the rented equipment.
15. Binding Effect
This Agreement shall be binding upon the Renter and the Renter’s heirs, estate, personal representatives, executors, administrators, successors, assigns, and Immediate Party. The Renter acknowledges that they have read, understood, and voluntarily accepted all terms and conditions contained herein.
